WHAT IS NOT ALLOWED
Our website is precious to us and we ask that you do not misuse our website in anyway. It is prohibited to use our site to encourage or commit a criminal offence; transmit or distribute any material, virus, worm, trojan or post any materials which could be considered malicious or harm our technology. You must not hack into any aspect of our technology, corrupt data or infringe upon the rights of another person’s proprietary rights; send unsolicited advertising or promotional material or access any data from this site. Noconah will at the first instance, report any such behaviour to the relevant law enforcement authorities.
We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it.
TERMS OF SALE
By placing an order with Noconah, you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price. Dispatch times may vary according to availability and subject to any delays resulting from postal delays or force for which we will not be responsible.
In order to contract with noconah.com.au you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. Alternatively, if you are younger than 18, you must have permission from an Adult.
Noconah retains the right to refuse any request made by you. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. All prices advertised are subject to such changes.
PURCHASING PRODUCTS
Prices are subject to change without notice. These changes will not affect orders that have already been despatched. Prices are inclusive of GST (where applicable).
Goods are subject to availability. As there is a delay between the time when the order is placed and the time when the order is accepted, the stock position relating to particular items may change. If an item you have ordered becomes out of stock before we accept the order we shall notify you as soon as possible and you will not be charged for the out of stock items.
We endeavour to continually update our website to keep it as accurate as possible.
REGISTRATION & YOUR ACCOUNT
When you register an account on Noconah, the following terms and conditions apply:
– You must provide us with true and accurate information that is requested. You must keep any user name and password allocated to you confidential, and we are entitled to assume that anyone using that user name and password is you.
– Noconah reserves the right to close accounts if you are seen to be using proxy IPs (Internet Protocol addresses) in order to attempt to hide the use of multiple accounts or disrupt any of our services in any way.
– Where you access the Website using a mobile device (e.g. a phone or tablet) through a web browser or an app, depending on your settings you may stay signed in from that device. This means that someone else with access to your device may be able to access your Noconah account(s). You should protect the device with a password, and if your device is lost or stolen, access your account from a different device and change your password immediately.
PRODUCT INFORMATION
We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor’s display of any colour will accurately reflect the colour of the product on delivery.
We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. We reserve the right to refuse orders where product information has been mis-published, including prices and promotions.
OUR CONTRACT
When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order: this email will only be an acknowledgement and will not constitute acceptance of your order.
A contract between us will not be formed until we send you confirmation by e-mail that the goods which you ordered have been dispatched to you. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.
RETURNS AND COLLECTIONS
Our products may come with guarantees that cannot be excluded under the Australian Consumer Law. You may be entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You also may be entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
If you believe there is a major fault with the products you have received, please let us know within 7-days by contacting us directly. Please include as many details as possible about the order and the problem with the goods.
This section applies to the return of all goods, regardless of whether they are faulty, or you choose your mind or need a different size.
For change of mind returns, the customer will be responsible for the cost of returning the products to us. Any goods returned are your responsibility until they reach our warehouse. Please ensure you package your return to prevent any damage to the goods or boxes. We are not responsible for any goods that are returned to us in error.
LINKING TO THIS WEBSITE
You may link to any page on our website, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

The Noconah mobile message service (the “Service”) is operated by Noconah (“Noconah”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Noconah’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Noconah through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, information, and tracking information (e.g., order updates, account alerts, etc.). Promotional messages may include specials, promotions, competitions, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Noconah. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to Noconah or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Noconah mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
